The Selection And Legal Construction Of Urban Community's Governance Model In China

As China's reform and opening up step by step, to bear the social function of urban communities have gradually increased, while in urban governance problems in the community are increasingly exposed. Therefore, our urban Community Governance is increasingly attracting party and state attention, in the party and the government actively promotion, since the 80's of last century, the growing urban communities in China and achieved certain results, and gradually formed a government-led executive-led governance model in urban communities. Community Governance is the processes of a government and communities to participate in community governance, it can not be only participated and leaded by government, if not many difficulties will arise. Therefore, China's urban community governance model of reform is imminent. The Chinese government also has recognized that, various reforms have also been widely launched. Similarly, it has also become a subject of academic focus of attention, mostly sociological method and perspective, does not know that community governance system reform and improve and ultimately to the legal recognition and protection laws for the Urban Community Improvement, is to promote Community governance model that the reform of one of the most important factor. This article is based on the current situation, hoping from the Law on Urban Community governance model I had chosen to study the issue and its legal construction, with a view to promoting the reform of China's urban communities to make a modest contribution.Article is divided into three parts:the first part of the urban community governance model outlined, mainly on the urban community governance model concepts and theoretical issues were also discussed. First, the concept of community and urban communities, the theory, research results are described; Secondly, governance and urban community management concepts and theories are analyzed and discussed; again, discussed the concept of urban community governance model, and theoretical circles recognized the existence of government-led, mixed, community autonomy characteristics of three models were discussed; Finally, explain the decision by the economic system of Urban Community governance model development process, mainly in the economic base determines the superstructure, based on the theory analysis of the Urban Community in China since the founding of the development process and the inherent momentum. The second part, mixed-use urban community governance model is the inevitable choice in China, this chapter discusses why the present stage and for a long period of time must select mixed mode of community governance reasons. Analysis of the three main reasons: the shortcomings of government-led model requires that we reform the foreign advanced management experience in urban communities provides us with mixed and community autonomy choice of two models, compared to community autonomy model hybrid model more suitable for China's national conditions, China's reform experience shows that regional patterns. The third part, the legal construction of mixed-use urban community governance model, analysis the shortcomings of our current executive-led governance model urban community from a legal perspective, and how to improve and perfect the relevant laws, and thus construct mixed urban communities governance model.
