The Dilemma Of Regulations On Open Government Information

The promulgation and implementation of "Regulations on Open Government Information" considered as a most thorough government self-revolution, and giving the best way to respect citizen's right to know ,was pinned our hopes.However, the implement status over the past year term, is not satisfactory. According to the analysis of "the annual report of the work of open government information"issued by local governments, universities and various organizations' social survey, the typical cases on open government information, I believe that less enthusiasm for government public information, low level of information disclosure, low citizen participation , and low satisfaction with the situation, will be proper to describe the situation."Regulations" falls into a reality dilemma .For not content about the explanatory power of rights and systems-focused analysis, the author choose to use national governance perspective to analyze the "regulations".In the process of national governance,which is the state use authority to deal with public affairs, the state must facing the problem of getting real information from the society. And at the same time, the community also need enough information to arrange production and life.For both ,information is essential.In different model of governance, the state chose different ways to solve this problem.As a state,which use the authoritarian model of governance in a long time, our choice is based on a informal system represented by Incognito Travel, Investigation and Research, Focus Interviews, and Southern Weekend.In the model of democratic governance, the state will choose to rely on government information disclosure system.The nature of Incognito Travel is personal challenge for the entire bureaucratic organization, doomed to failure; Investigation and Research is too dependent on bureaucratic organization and can easily be digested by bureaucratic organization, at the form of"information black hole effect" ; Focus Interviews and Southern Weekend ,due to the lack of market-oriented, has no independent property rights and suffers administrative power interference ,can not solve the problem.Deficiencies and weaknesses of the informal system, destined only the formal system can solve the flow of information in national governance.Along the national governance perspective,the choice of governance mode itself framed the way to deal with information flow. China's authoritarian model of governance excludes opening information.However, the needs for information of the community is so strong, and even led to the contradictions and conflicts between government and the public. In the long run, government information disclosure system is sure to be gradually improved,but due to the breeding failure of civil society, doomed to be slow and painful.
