Energy is the lifeline of the national economy of a country's economic, having pivotal role in political, national security, social life. At present, there are major problems in China's energy sector, including energy systems, energy restructuring, energy security, welfare issues of energy, environmental issues of energy. These problems have seriously restricted the comprehensive utilization of energy in our country, which restricts the development of China's economy. Energy issues arise largely due to China's energy management problems. China is currently developing "Energy Law of The People's Republic of China", the basic laws of energy,which has a commanding role to other laws in the energy law sector.The provisions of the energy management system play guiding role for other energy special law and energy administrative regulations.In the "Energy Law of The People's Republic of China"(revised draft), energy management system is dedicated in a separate chapter,demonstrating the important position of energy management system in the "Energy Law".This article mainly discuss the building of energy management systerm,hoping help the formulation of "Energy Law". This article mainly includes four parts.The first part introduces the meaning and nature of energy management system, and then discuss the constituent elements of energy management system from the aspects of the energy law and energy management authority, Finally discussing the factors affecting the energy management system and the model of energy management system.The second part is mainly introduced the situation of China's energy management system. On the one hand China's current energy legal system has taken shape, but still not perfect, there are a series of problems.,such as the loss of the energy basic law, loss of some important energy single law and so on.The infirmity of energy law caused the confusion of energy management system. On the other hand, China's energy management system changed frenquently. Now we adopted a low-level decentralized energy management mode, Energy Regulatory Commission is China's highest-energy management sector, Energy Bureau under the director of the National Development and Reform Commission's is in charge of China's energy sector and is the offices and executive agenciesof the Energy Commission. At the same time the State Department of Land and Resources, Ministry of Commerce, the State Electricity Regulatory Commission, the Environmental Protection Department and other departments also enjoy the right energy management.The third part mainly focuses on the energy management system of major countries abroad such as Canada, the United States, Russia, Australia and other countries and draws lessons. Most foreign countries have a sound legal system of energy to ensure the legitimacy of the energy management system. most foreign countries have set up a high-level energy management mode, and set up a special independent energy regulatory bodies, achieving the separation of the energy policy-making functions and executive functions.The fourth part is the innovative point of this article, make recommendations to build China's energy management system on the basis of the question of China's energy management system, as well as the lessons from the abroad country's energy management system.In the energy law, we should adhere to ecological principles, the public interest to construct the energy law system. In the energy sector, it should separately set up departments in charge of energy and energy regulatory body. The energy department as a comprehensive energy management agencies, it should be mainly responsible for the formulation of national energy policies, strategies, planning, co-ordination between the relevant departments and different types of energy development. Energy regulatory body as an energy source law enforcement agencies, should adhere to the principles of supervision according to law, the principle of independence and open regulatory principles to specific energy market regulation, the implementation of national energy planning and policies to ensure the efficient functioning of energy markets.
