Through years of practice, Chinese peasants gradually found the community cooperative a useful and powerful mode to overcome the shortcomings of the traditional household contract responsibility system. However, the lack of solid legal ground in this area is seriously hampering the development and popularization of the community cooperative system in the countryside. This thesis tries to explore the rules of the community cooperative system and to provide valid laws and regulations, which may give theoretical instruction and build solid legal ground for the healthy development of the rural community cooperative system in China's countryside.Based on the basic theories of cooperative system, this thesis defines the rural community cooperative and summarizes its differences with other cooperative economic organizations. The thesis aims to help the legislation on China's rural community cooperative with a solid research of China's rural realities and a comparative study of relative experience from Japan and Korea. The thesis is mainly consisted of four parts. Part One introduces the definition and principles of cooperative by ICA. Part Two attempts to define China's rural community cooperative based on a thorough study of related concepts. Part three conducts a solid research on the status quo of China's rural community cooperative and on the government's policy on this field. It justifies the present the rural community cooperative and predicts its developing trend on the bases of a comparative study of relevant experience in Japan and Korea. Last but not least, the thesis discusses related laws and regulations on this field.
