Research On Restricting Factors And Countermeasures Of Fulfilling The Rights Of Self-governing Of Universities And Colleges

One of the significant issues in higher education and in relations with government agencies is the rights of self-governing, which also long puzzles the development of higher educational administration theory and practice. Since the end of 1970s, our country began to research the rights of self-governing from theoretically aspect and practical aspect. 'The Higher Education Law', which was put into practice in 1999, used seven items to ordain the rights of self-governing which the universities and colleges owned. The law affords the legal insurance for fulfilling the rights of self-governing and administering the universities and colleges by law. It can be say that the research about the rights of self-governing have made big progress, the fulfilling of the rights of self-governing have made further deepening in content and form. However, the fulfilling of the rights of self-governing still have many unsatisfactory aspects and it is difficult for universities and colleges to fulfil self-governing.On the basis of former research findings, the dissertation, by taking the methodology of theory study and practice study, and using generally comparatively analytic method and historically analytic method, studies the status quo, restricting factors and countermeasures about the rights of self-governing of universities and colleges in China. Several representative nations which have distinguishing features and successful experiences in self-governing of higher education institutions, like U.S.A, Germany, France, etc. are chosen to be compared for the referential study. Their advanced and successful thoughts, experiences and methods of the pattern of self-governing are widely adopted to guide the practices. By making practical investigation, the author knows the status quo and existed problems and analyze the restricting factors from traditional culture, thoughts and ideas, politics, economy, law, government, universities and colleges, the system of supervision. Finally, the dissertation proposes the countermeasures and advices to fulfil the rights of self-governing of universities and colleges. The universities and colleges should exert the function of main body by improving the independent consciousness;The government should change the functions and managerial pattern and regulate the rights and duties to strengthen the ability of macroscopical management;The market should exert adjustive function by perfecting marketable system, by doing that the higher education institutions can run the schools facing to the society and independently;The educational agency organization should be establishedto harmonize the relationship between the higher education institutions, the government and the market.
