Along with society's civilization progress, the education penalty traditional legal status and the function receives people's question. Facing each kind of unreasonable and illegal phenomenon, people start to reflect: what is the education penalty? Is it necessary for education penalty to exist? If it indeed has the reason to exist, what is the purpose of the education penalty? In order to achieve the purpose, what penalty methods are reasonable? The series of questions must be answered and explained reasonably. In education practice, perhaps one of the reasons that make education penalty improper is educators'lack of reasonable knowledge. Therefore, rationally understanding the education penalty is the premise and the foundation of rationally using the education penalty.The paper divides into three parts to discuss the education penalty. The first part discusses the ontology of the education penalty. Beginning with three kinds of penalties views in history, it inspects the connotation, essence, goal as well as method of the education penalty. The second part discusses the education penalty from an opposition pair of category that is rationality and the non- rational two aspects. In rational aspect, the paper illuminates the necessity and possibility of the education penalty from human nature, contrary behavior, and education need. In non- rational aspect, the paper prove the reality of the education penalty from the performance, the harm, the root. By this we can have a sober understanding to the reality. The third part is based on the first two parts to resolve how to use the education penalty reasonably. It discusses the principle which the education penalty should follow, and discusses the strategy that the education interior and the outside should adopt. The paper tries constructing the ontology theory of the education penalty, with the hope that it may offer valuable ideas for the fundamental research and the practice of the education penalty.
