Since we titled and applied The People's Republic of China's Non-governmental Education Promotion Act, our private primary and secondary education is gradually transiting from elementary time to mature and regulatory time. The implementation of teacher's teaching right in our private primary and secondary school is the key factor to achieve this transition. SoThe dissertation selects our private primary and secondary school teachers in the south of Jiangsu, Xinjiang and Anhui as its research object, because the south of Jiangsu is the economically developed zone in our east, and Xinjiang is underdeveloped county in our west, and Anhui is the middle in our country. We survey and analyze the present situation and affecting factors of these teachers'teaching rights by questionnaire and interview methods.We have several conclusions from finding. The first, the teacher's teaching right in our private school is not satisfaction in the mass, it's even lower in the rights of personal ideology and punishment to students; Second, in teacher's personal features, teacher's teaching rights have significant difference in their degree and school ages, the teachers who have the junior college diploma and the teachers who have the school ages from 16 to 25 years have the higher rights. Thirdly, in the aspect of our private school's features, the teacher's rights have no significant difference in a mass in differently zones, but have certain distinction in the rights of participation and ideology, and the rights of independent selection, the teaching rights in Important School is apparently higher than that of general schools. Finally, the key factors that affecting the teacher's teaching rights in our private school are those five aspects by the influence scores: teacher's personal quality, school's educational management, traditional examinations system, educational legislation and the education management departments.Finally, this thesis provides operational measurements and suggestions about protection the teacher's teaching rights from external environment and their inhered quality. The external environment includes strengthen the private's educational legislation, he education management departments taking into account the private education, reinforcement school's democratic management and consummation the teacher specialized organization; The inhered quality means enhancement teacher's own including the raise law knowledge and consciousness, the development specialized knowledge, improvement the scientific research ability.
