Content: Today, the right to education is recognized one of citizens' fundamental human rights in worldwide. It is not only affirmed and protected by World Declaration of Human Rights and International Convention on Economy, Sociology and Culture, but also a constitutional right stipulated by most countries, including China. With the progress of society and living level, people have been paying more attention to their rights. People are not only keen to the obtainment of basic education, but also have begun to require more chances to be educated and enhancement of education quality. The realization of the right to higher education has been the focus of people. In recent years, a series cases of violation to the right to higher education happened in china. These cases either happened in the process of people's application for higher education or happened in the process of people being educated. However, its theoretical study is backward in China, and there is no effective guarantee mechanism in practical field. The backwardness and faultiness result in ineffective protection and relief to the right to higher education. This article, probing into the fundamental theory of the right to higher education and its guarantee principle, comparatively researching into the guarantee mechanism of foreign countries, empirically analyzing the problems in practice, tries to put forward some ideas to optimize the guarantee mechanism for the right to higher education.
