| The starting point of the reform of the employment system of college teachers in our country is to achieve a more comprehensive maintenance of the rights and interests of college teachers by optimizing the relevant allocation of human resources.However,by consulting a large number of documents,it can be found that the current employment system of college teachers in my country is still in the stage of reform and exploration,the policy environment suitable for it has not been completely formed,and the relevant supporting laws are also in the embryonic stage,which makes the legitimate rights and interests of college teachers in our country repeatedly violated.Therefore,in the process of the implementation of the teacher appointment system,how to properly handle the main body of multi-stakeholders and realize the effective maintenance of the rights and interests of teachers in colleges and universities is an important research topic.Based on this,this paper takes stakeholder theory and Maslow’s hierarchy of needs theory as theoretical guidance,and conducts research on the main content of the paper through literature research,field investigation,semi-structured interviews and other methods.Focusing on the group of teachers in H colleges and universities in Shanghai,on the basis of studying the relevant literature and laws and regulations on the protection of teachers’ rights and interests,combined with in-depth interviews with the personnel departments of colleges and full-time teachers,this paper explores the current situation and problems of the protection of teachers’ rights and interests in H colleges and universities in Shanghai.The study found that although the basic framework for the operation of the teacher appointment system in H universities has been initially established,due to the lack of concept guarantee,institutional guarantee,organizational guarantee and institutional guarantee of teachers’ rights and interests in my country’s colleges and universities,the rights and interests of teachers in the implementation of the appointment system in H universities have been caused.In the current situation,there are still a series of problems such as the unequal status of the contracting parties;the weak awareness of teachers’ rights protection;and the imperfect organizational functions.On the basis of discovering problems and analyzing the reasons,this paper proposes an optimization path for the protection of teachers’ rights and interests in colleges and universities.At the level of concept protection,schools should update their employment concepts to demonstrate the correct value concepts.Teachers should enhance their legal and democratic awareness and cultivate their legal practice ability;at the level of institutional protection,it is urgent to promote legislative protection of teachers’ rights and interests and improve the employment contract system;In terms of guarantee,it is required to improve the guarantee of teachers’ union as soon as possible,and fully implement the system of open school affairs;in the aspect of mechanism guarantee,a school-based employment period assessment and evaluation mechanism should be constructed,the appeal mechanism of college teachers under the appointment system should be improved,and the restriction and supervision of college employment rights should be
