This paper focuses on the realization of the fairness in education. With the basic education policy as the entry point and the administrative decision-making against the Administrative Law as its perspective, this article discusses how, by improving the quality of basic education policy-making, the interests of different parties can be coordinated and the realization of the fairness of education be accelerated so that social fair and harmony can be promoted against the background of building a harmonious society and a democratic, open and responsible government.This paper consists of five parts. The first part Value Orientation of the Education discusses the function of education in promoting social justice, human ideal and practice in pursuing fair education and due connotation of fairness at the stage of basic education. The second part Value Orientation of the Education Policy mainly talks about the four value areas education policy pursues, namely politics, society, education, and self-realization, and the intrinsic links and conflicts among them. The third part the Main Composition and Main Needs of Education Policy-Making focuses on the interest needs of different social agents that take part in decision-making. The fourth part Changes and Rational Choice of the Basic Education Policy of China deals with the four stages of the development of China's basic education and the characteristics of the policy, and puts forward the corresponding viewpoints on what choices should be made at the transition of China's basic education. Then based on the four parts, the author gives his own conclusive viewpoint, which constitutes the fifth part of the paper Improve the Quality of the Decision-Making for Basic Education—the Legal Way to Promote Fair Education. This part emphasizes that in the process of decision-making for basic education policy, the essential need of the public participation should be embodied by means of perfecting information release system, encouraging public involvement in education policy decision, establishing and perfecting channels of the system of public hearings, so that the purposes of improving the quality of decision-making and fairness in education can be fulfilled.
