Research On Right Protection Of Land Expropriated Peasants In Land Expropriation

In recent years, as the process of China's urbanization and industrialization speeds up, a large number of collective-owned rural land have been expropriated as state-owned land for construction. As a result, lots of peasants became landless, and the population of landless peasants is increasing. It is important but very difficult to solve these problems of landless peasants, which relates to the development of society and economy and the establishment of a socialist harmonious society in our country. How to reform the existing land requisition system and protect the interests of landless peasants has become the focus of the academic community's attention.While referring to land acquisition and protection of landless peasants' rights, some important theoretical and social problems are involved. In the process of land acquisition, things that farmers lose are not only their land, but also a series of rights and interests that associated with land directly or indirectly. Furthermore, Land acquisition also involves a series of social problems related to the vital interests of farmers, such as the basic guarantee of life, social security, employment security, medical security and the democratic rights guarantee, etc. The causes of these problems not only include defects of China's current land requisition system, but also relate to China's long-standing issues of property rights of rural land that failure to resolve, the social security system, social supervision mechanism, the quality of the rural population and the concept of local economic development.As one of the developed cities in the region of Yangtze River Delta, the city of Suzhou has done positive and useful exploration and innovation to improve the system of land requisition compensation and resettlement, make innovations on the model of job placement, and build a sound social security system, so as to establish a new compensation and resettlement mechanism of land requisition based on the government action-oriented action, and has solve the problem of landless peasants rights protection perfectly, which is worth learning by other cities throughout the country. Based on the summarization and analysis of the existing researches on the land requisition system and the protect of landless peasants' interests, this paper analyze the status quo of China's land requisition system and the living status of landless peasants, and point out their existing problems. And then, the paper provides some innovative models which made by Suzhou city to settle the problems mentioned previously in the form of evidence. And it sums up their problems that still exists, and finally concludes with a series of policy proposals to improve the protection of landless peasants' rights further.
