From System To Right: Argument For The Legality Of Social Welfare

Welfare, a word meaning so much, is the human beings' effort for good life. In reality it acts like all kinds of social services afforded by the country and other social entities. Its meaning and scope are analyzed firstly in this paper, from which the author agrees on the comprehensive knowledge of welfare. Based on this, the theoretical fundament of social welfare is analyzed from three points: the human nature, the struggle for freedom and the social justice. Then the author point out from the view of the rule of law, that according to its nature of right and its normative requirement the social welfare ought to be ruled by law. On the focus of social welfare that the role of country and single person in the social welfare, the author considers the obligation of both country and single person as the basic of the social welfare. On one side welfare is called by citizens on country, on the other side the single person is the fundamental element in an effort to good life, so the social welfare requires the effects of both country and single person. At last, several problems of Chinese modern social welfare are analyzed.
