After the policy of reform and opening up, teacher's employment in public primary and secondary schools is to be fully implemented step by step. In the process of the implementation of the teacher employment, many regions have been actively exploring, and made some efforts on the refinement of the system. However, due to the different parts of the actual situation, as well as understanding and awareness of school leaders and education department is different, in the implementation process, there are still a lot of problems, such as the employment system, the status of employees and employers, and the protection of legitimate rights and so on. Therefore, it is imperative to find the root of the problem and find solution to the problem. Employment of teachers in U.S. public schools is relatively perfect; we can find practical way to improve ours with the study and comparison on its teacher's employment.On the basis of documents analysis and comparative study, this paper tries to give some reflection on the history of employment of teachers in public primary and secondary schools between China and America. Through the comparison, we can find that the employment of teachers in public primary and secondary schools of the United States, which is more perfect, with standardized procedures, and emphasizing standards and jurisprudence. China's employment of teachers in public primary and secondary is gradually to be improved; and the ideas of people which are related to this system have changed, the government also stresses its action on this area.By applying comparative research method, the author compares the teacher's employment of two countries with the following five aspects: the employees; the demands of employment; the procedure of employment; the contract of employment; the dismissal of teachers. From the research, we can find that the employment of teachers, in public primary and secondary schools of the United States, focus more on schools, parental involvement, and decision-making together. The teacher's employment of two countries is based on the teacher's qualifications certificate, but the types of teacher's certification in public primary and secondary schools of the United States is more than our countries, and the duration of it is more specified than ours. China's educational administration department of the appointment of teachers in public primary and secondary schools played a leading and decisive role. The classification of teacher's certification in public primary and secondary schools, compared to the United States, is subtle. Appointment procedures are not standardized, in many cases even evolved into "skimming the surface." The status of teachers in the contract, in China's public primary and secondary schools, is unequal. Educational and administrative departments and schools usually have the advantages, that is to say, they have rights to implement or change the decision, or the content of contract. As for the dismissal of teachers in public primary and secondary schools, China's current education law, are no specific provisions, which also makes the interests of teachers is difficult to be guaranteed.With the comparison, improving the teachers'certification, employing the teachers by law, focusing on the appointment of teachers in rural schools, is the strategic choice to standardize the appointment of teachers.
