A Research On Deepening The Land Recruitment System In China

The land recruitment system is an integrated system which includes some property rights assignments and controlled procedures. This system is used to standardize the transform of the farmland which is a basic economic element into the non-rural land. At the beginning of the building of the P.R.C., the relative sectors had set up the land recruitment system and it lasted to today. Although this system has being adjusted and perfected during the system evolvement, the current system still has some characteristics and problems of the plan economy.The current laws and regulations didn't precisely define the public interests which refer to the land recruitment right range. Therefore, the problems of enlargement of the land recruitment and the abuse of the land recruitment right have come out. Thus, the right of free land remising for farmers and the property right which is attribute to the collective lands in rural area have been neglected. As a result, the legal land collective interests of farmers and farmers' individual interests have been harmed.In recent years, dissensions and appeals to the higher authorities for help come out one after another. And the phenomena of land lost for farmers become more serious. The problems deriving from the land recruitment system have being becoming complex problems relative to economy, society and politics other than simple economical problems. If these problems can't be solved, they may influence the healthy development of the socialistic market economy and the establishment of socialistic harmonious society. The decision makers have paid high attention to the problems of the current land recruitment system. In 1999, the central government and relative ministries and commissions have organized and done some theory research work and experimental reforms. By doing these jobs, the land recruitment system reform has being quickly promoted. However, the current reform still has some big limitations and weaknesses.At the same time, the theory circle has taken some deep and extensive research and studies in land recruitment system. Though some positive results had been formed, there still are many shortcomings. Of which, the researchers didn't assume overall responsibility in the reform and land market concerted development and take the land recruitment system reform as a system engineering. So, the author will take the land recruitment system as the research subject, put forward a comprehensive plan for reform based on the reflection and sum-up of the previous reform achievements. By writing this paper, the author wishes make some contributions to the land recruitment system reform as well as provide some constructive suggestions and theoretical supports for the government and some relative sectors to do the land recruitment system reform.The author puts forward that the division between the pubic interests and non-public interests is the precondition of the deepening of the land recruitment system reform. The farmland property right system is a key to deepen the reform. The author also suggests that use the farmland requisition by purchase to replace the current land recruitment system and make fair compensation. The whole article is divided into five chapters. Chapter one is the introduction which includes the background of the paper, the significance and research methods. This part will summarize the writing plan and frame, and emphasize the creativity points.Chapter two firstly summarizes the land recruitment system theories and introduces the land recruitment system in China. Chapter three is about the history of land recruitment system in China and the major problems in the current land recruitment system and the reasons. In chapter four, the author expounds as well as appraises the contents and fruitful results in recent years. And the author also writes about the limitations of the current reforms and the methods choose to deepen the land recruitment system reforms. Chapter five is the most important part of which put forward the principles and ideas about the land recruitment system reform and provide some constructive suggestions and theoretical supports for the government and some relative sectors.
