A Research On Flexible Contract Networks And Enterprises' Monopoly Structure Mode In The Era Of New Economy

Contract theory is an important research direction of new institutional economics, by far it has already been the common study field for economist, management scientist and jurist, economics communicates with correlational subjects just through the reseach of contract theory. The study object of this article is the development and application of contract theory under new economy conditions-A problem on Flexible Contract Theory Systems and Enterprises' Monopoly Structure Mode.With today' s world economy stepping into the era of new economy, which displays three main economic patterns, knowledge-based economy, information-based economy and network economy, the pattern of inter-firm organization changes greatly, its' leading pattern has started to change from vertical integration to horizontal integration, which more and more takes on the characteristics of flexibility, modulization , virtualization , etc. Enterprises are made up of a series of contracts , the change of enterprises' organization brings about the corresponding alteration of contractual arrangements, which are used to regulate all kinds of relations among or between enterprises. Upon the background, we put forward the concept of flexible contract from the view of enterprise contract theory, extensively explore the theoretical origin , cause and components of flexible contract, preliminarily construct flexible contract theory systems. Then we definitely study on the relative problem about flexible contract network and enterprises' monopoly structure mode on conditions of new economy, the result of which displays different patterns of network organization, such as virtual enterprise and strategic alliances that are took shape by increasing and decreasing, arranging and composing flexiblecontracts, these flexible contract networks are characteristic and efficient. Flexible contracts are contractual institution arrangement of network organizations. In the end we specificly study on the monopoly structure problem through an allied network organization guided by a huge substantial enterprise (take the IBM for example).As a relational contract under the framework of incomplete contract, flexible contract is the contractual arrangement, which is used to regulate all kinds of relations among or between enterprises. In the era of new economy, the development of computer network and information technology makes it possible to construct good trust relation for network nodes. The function of flexible contract is based on the background of new economy, flexible contract is the result of general enterprise contract theory' s progress with the age of time. The construction of flexible contract theory systems can not only explain how the network organizations (such as virtual enterprise) perform very well and where the high monopoly structure benefits come from, but also have great theoretical implications for the further research of enterprise theory, organization theory and enterprise contract theory.
