The labor relations are becoming tense day by day in the background of the rapid growth of the global economy and the further establishment of the social market economic system.Using the experience of other market economy countries for reference, we manage the contradiction of the capital and labor and promote the coordinated social economic development by the means of Tripartite of the labor relations. There are a lot of problems and difficulties impairing the effectiveness of the system at the first stage. This thesis makes a research on Shanghai Tripartite of the labor relations through five aspects.In the first part of this thesis it expounds the significance of Shanghai Tripartite of the labor relations. By absorbing the experience of the developed market economy countries, Shanghai Tripartite coordinates the relations of different groups, surmounts the difficulty of "invalid market function" and alleviates the contradiction of the capital and labor. At the same time this system also has many deficiencies to be perfected. It supplies a good research case for the public management and gives impetus to probe a new model to adjust the labor relations.In the second part of this thesis it outlines the present situation of Shanghai Tripartite of the labor relations. It shows that Tripartite of the labor relations has been formed at the macroscopic level from the view of the background condition, actual practice and initial achievements.In the third part of this thesis it introduces the Tripartite of some areas in China and developed market economy countries abroad. It describes the models of three-party coordination system in Great Britain, Holland, Italy, Japan, Korea, Singapore, Malaysia and Hong Kong. It points out that we should learn and make use of their experience as the terms of the sense, the legislation, the government function and the organization construction.In the fourth part of this thesis it analyses the problems of Shanghai Tripartite of the labor relations. By citing the case "To solve the problem of arrears of salary ", it points out that the system does not work well, the main parts of consultation are absent and the government function is not clearly defined. There are four reasons of these realistic problems. The first is the influence of the intensifying contradictionbetween the capital and labor. The second is the deficiency of the consultative capability of two main bodies in the system. The third is the invalid government function caused by excessive intervene from government. The fourth is for lack of the support of law. It points out that the government is the motive force for the development of the three-party coordination system.In the fifth part of this thesis it points out by using the relevant theories of sociology, public administration science and political science that Shanghai Tripartite of the labor relations should be perfected to have a positive effect. This system can adapt itself to the challenge of global economy and the change and development of labor relations. It also can relieve the social conflict and widen the dialogue channel to realize the change of governmental management function. For this reason, it puts forward a proposal of perfecting the three-party coordination system from the view of legislation, main body, operation and government. It is the future development of the system that negotiated by two main bodies and adjusted legally by the government.
