With the development of national economy , the process of urbanization and the industrialization , as well as the expansion of urban areas , more and more farm land has been in constant requisition for economic construction . The transitional parts where the urban areas and rural areas meet have to bear the brunt in the process of city expansion . As most of the land there are farm land which belong to the collections of farms , the requisition of the farm land in these connected areas has been a problem that has aroused great attention.Land requisition system currently in our country came into being in planned economy period which have made a development in some degree . With quick development of economy, however , this system becomes more and more difficult to adapt to the need of new condition . During the course of land requisition , there exists many abuses such as too wide range of land requisition , unreasonable compensation standard of land requisition , incomplete measure allocating farmers whose land has been expropriated , nonstandard behavior of land requisition , and nonstandard management and surveillance . AH these abuses do a large harm to the legal right of farmers , make their life and employment have no safeguard , the problems caused by this increase constantly , the conflict between the government and the farmers prick up day and day increasingly , and make some threat to social stability . Therefore , it has very important theoretic meaning to reform of land requisition system that aiming at these abuses in the land requisition , study and explore seriously new types of land requisition system which suit for the need of the socialism market economy .After an introduction of the regional theory on suburb areas , the paper has analyzed the land utilization structure in the suburb areas . Taking the Quiwen district in Weifang city as the example ,we can see that a large amount of farm land in these areas has been transformed into the building land . And with the further expansion of the cities , the farm land in the outskirts will be taken over for building use . At present , the system of land requisition in our country can't meet the demand of market economy development ,thus the reform of land requisition system will be the fundamental way to guarantee the smooth requisition of farm land . The system of land requisition is a system of land management which can find extensive application in many countries and districts in the world . It has definite using objectives strong enforcement and appropriate compensation , which are similar in these countries.First of all ,the paper gives a introduction of the land requisition system in foreign countries as well as Hongkong and Macao districts of our country . Then it had summarized the main features of the system in these areas and the inspiration we could get .After a brief review of the changes in the land requisition system in our country , the paper has drawn upon the advanced experiences of foreigncountries and analyzed the drawbacks existing in our current system of land requisition in order to provide some foundation for the reform in land requisition system . Starting from the overall requisition in establishing the socialist market economy system ,the paper has proposed that the final goal in the reform of the land requisition system is to set up a land requisition system in accordance of the market economy . Then it has elaborated that the land requisition system is a new model of land requisition with the combination of four parts which are the land collection , land requisition , land purchase and land return . For the land belongs to farmers' collectives and the utilization right of the state-owned land jvhich has to be returned in advance , we should adopt different methods to realize the transition of property rights among different groups by distinguishing whether the projects are for pubic good or not. The paper has given a detailed introduction of the different models of land requisition and purchase in the suburb areas.At last, taking Weifang city as an example , the paper explains the actuality , countermeasure and the model of compensation and allocation of putting in practice land requisition by purchase . |
