Study On Farm Land Requisition By Purchase In Urban Planning Areas

The system of socialist market economy has been set up gradually in our country. With the development of national economy, The process of urbanization and the industrialization,more and more farming land has been in constant requisition for economic construction.In the Urban planning area, the farm land which is used by the economic construction and the development of national economy is the important part in the acquisition and reserve of city land, otherwise, Land requisition system currently in our country came into being in planned economy period which have made a development in some degree .With quick development of economy, however,this system becomes more and more difficult to adapt to the need of new condition .During the course of land requisition,there exists many abuses such as too wide range of land requisition,unreasonable compensation standard of land requisition,incomplete measure allocating farmers whose land has been expropriated,nonstandard behavior of land requisition,and nonstandard management and surveillance .All these abuses do a large harm to the legal right of farmers,make their life and employment have no safeguard,the problems caused by this increase constantly,the conflict between the government and the farmers prick up day and day increasingly,and make some threat to social stability .Because of the expansion of urban areas, the farm land conversion become more and more familiar, Farmland is complicated system that consists of nature, ecology, society, and it is the source of the surviving of human beings. Therefore,it has very important theoretic meaning and practical meaning to reform of the system of the acquisition and reserve of city land and the land requisition system .Starting from the overall requisition in establishing the socialist market economy system, the paper has proposed that the final goal is to set up a land requisition system in accordance of the market economy. Then it has elaborated that the system of the acquisition and reserve of city land is a new model with the combination of five parts which are the land collection,land requisition,land purchase,land return and land requisition by purchase, and we take the example of the section of Chang'an in Xi'an to validate the rationality and application.
