Many researcher has studied the issue about family farming institution in china ,which are concentrate two aspects ,some mainly discussed the land rights how to influence the action of farmer ,for example the different land rights how to influence the investment of farmer to land .the others are concentrated to studied if the family organization is more efficient. the institutional circumstance of family farm in china has changed greatly from 1998.we connected this changes to discuss the problem on the persistence of family farming institutions in chinaThe first,we analyzed the security of land rights with the game theory and draw the that the security of land rights is high in the progressed and rich distracts and the distracts that lands necessary long investment. Second we analyzed the efficiency of family farm with the theory of Institutional Economics ,we draw the conclusion that the efficiency of family farm is not lower than the firm farm.Third,we analyzed the institutional circumstance and draw the conclusion that the fees that the farmer in China get the land rights is becoming more cheap.In all.The first,we should insist on family farming institutions .but that does not mean the family farming is the only ways to produce in agriculture to make the family farming institutions persistent,we must think over the farmer who does not benefit from the land rights innovation ,the government should think over to compensate their lost because they contribute to the security of land rights.The second,we should insist on family farming institutions,but that does not means it is the only means to organize to produce in agriculture,the third,the farmer should cooperate to deal with others and enlarge their land farming scale.
