| Along with the economical development and urbanized advancement speeding up, more and more agriculture land needs to transform use for the construction through confiscation. Our country land requisition has begun in the planned economy time; it has made the significant contribution for the national economic construction and the social development since the founding of our country. But along with the market economy establish and consummate gradually, the flaw of present expropriation system appear day by day, in which contradictory of compensation question is prominent. Excessively low compensation cannot be able to guarantee farmer's production and the life, the land confiscation causes the peasant economy welfare to drop, compensation is obvious unreasonable. This article drafts the system reform key question—the establishment of land value compensation of standard, the aim is to explores one kind to be fair, reasonably, effective drafts compensation method under our country present stage finance payment ability, seeks reasonably compensation price, so that providing some suggestions to the reform of land confiscation compensates in our country.Based on massive literature material consulting and investigation, the article take the theory of working value theory, Marx land rent and price theory etc as the foundation, studied firstly from the basic implication and the characteristic of land expropriation, reviewed the land expropriation system of our country, analyzed the main question which present drafted compensates exists. And using the correlated theoretical, the paper analyzed and drafted the main reason of low compensates. In this foundation, proposed the conception of reasonably compensation, which thought the expropriation cannot reduce farmer's economical welfare, therefore the article from the farmland effectiveness angle proposed the price of land expropriation for compensation should be made up of social security value and economic output value, social security value should include the farmland to care for the aged, the employment and the medical safeguard value. At thesame time, the article had constructed again the standard and quantification method to compensating, using this method, the article had estimated the price of land expropriation of the public welfare aim to Chengdu in 2002, studies show that: the reasonable price of land expropriation in Chengdu is 172120.13 Yuan every acre, placement subsidy is 99095.67 Yuan, it is far higher than the present standard of 16,000 ~ 18,000 Yuan.The main conclusion of this research is: First of all, the current standard of national compensation in expropriation of land is far from remedying peasant's loss, land acquisition causes peasant's economic welfare to drop. Secondly, price distortions, the fuzzy land right and wrong calculating method are the main reason of low compensation. Moreover, in order to ensure peasants' basic existence state not being damaged and getting certain development in the future, nation must rebuild the compensation standard of land expropriation. The minimum standard of reasonable compensation is to keep peasants' economic welfare same as before expropriation, so the foundation of compensation is the actual utility of land to peasants. Finally, the farmland has two basic functions of economic outputs and social security, so land acquisition should compensate from these two mainly aspects in order to remedy the loss of parents, namely, the prices of compensation is made up of farmland economic output value and social security value. The method of numerating compensation should draw lessons from farmland price appraising and business insurance calculating for fully counting the value of farmland. |
