With economy globalization and knowledge economy development, the export of high-tech products has become an important index for judging a country's economic strength, technological strength, and export strength. China has thus formulated policies to promote the development and foreign trade of the new and high-tech enterprises. Though the foreign trade of these enterprises has become a new growth point of China's export trade, their foreign trade competitiveness is still weak compared with those from developed countries, for lacking of core technology patents. This paper aims to study how to implement patent strategy in new and high-tech enterprises in order to secure more patents and enhance their trade competitiveness. The main part consists of three sections:Firstly, theoretical, empirical and comparative analyses are employed to analyze the impact of patent strategy of new and high-tech enterprises on their foreign trade competitiveness. The theoretical analysis focuses on how patent strategy works on resources and technological innovation ability, and then makes new and high-tech enterprises gain competitive advantage and enhance their foreign trade competitiveness. It focuses on two aspects. On one hand, with the number of patents as the indicator for measuring patent strategy, an analysis is made of the correlation between the number of patents and export performance and TC indicator of new and high-tech enterprises. And the regression equation is formed, which shows the existence of a strong positive correlation between them respectively. On the other hand, a comparative analysis is made of the patents and international market shares of high-tech enterprises from United States, Japan and China. Through this empirical analysis, we find that patent strategy of new and high-tech enterprises has positive effect on achieving foreign trade competitiveness.Then, based on data and statistic results of a questionnaire survey, an analysis about present status of the foreign trade competitiveness and the implementation of patent strategy of Chinese high-tech enterprises is made. This analysis shows that the foreign trade competitiveness is still weak, though better than before. The reasons are many and varied: imbalanced export products structure, exports mainly relying on processing trade and joint ventures, etc. The same is true with the implementation of patent strategy where we find problems like insufficient awareness of patent strategy, insufficient investment in R&D, lack of intellectual property management system, inadequate government support, etc. An analysis of these problems leads to the following section which focuses on how to implement patent strategy in light of these problems in order to enhance foreign trade competitiveness.Finally, a patent strategy implementation framework is formulated to enhance foreign trade competitiveness of new and high-tech enterprises. This is formed with reference to the successful experience of Huawei Company, and based on the idea of strategic management in light of the present status and problems as stated above. Suggestions are given that these enterprises carry out suitable patent strategies through strategy analysis and strategy implementation with necessary support. To be specific, a strategic analysis should first be made of external and internal environment, based on which patent development strategy, patent operation strategy and patent protection strategy are implemented. Meanwhile, both government and new and high-tech enterprises should provide all the necessary support in the process of strategic analysis and strategic implementation.
