The Research On Land Acquisition's Compensation Problem And Countermeasures Of Changsha City

In recent years, along with our country's accelerating urbanization, the issue of compensation caused by the land acquisition has become a serious problem which has greatly influenced the rural economic development and the social stability in our country. The theoretical research in the domain of this kind of compensation is just based on solving the problem that farmers whose land was levied are often being infringed and also based on protecting their rights of living and developing. Specifying the practical problem of compensation of the land acquisition in Changsha, the primary purpose to raise this question is to protect the legal rights of farmers whose land were levied and to safeguard the proper social equity and justice. Therefore, we aim to maintain the sustainable development of rural economy and society and we also aim to provide theoretical support to construct the harmonious and stable social relations in the rural areas. It is also the starting point and standpoint of my research.This article first define the basic concept of land acquisition compensation and distinguish the similarities and differences between land acquisition and land expropriation, and then analyze the characteristics ,the principle and the theoretical basis of land acquisition compensation. Next, on the basis of elaborating the basic status quo of Changsha City land acquisition compensation, this thesis analyze the problems of land acquisition compensation from the main land acquisition, the scope and the standards of the compensation, the way to relief the compensation controversial problems in areas such as Changsha City , and analyzes the reason why the land acquisition compensation question engenders from three angles that the land property system, the national land acquisition compensatory regime and the local authority participates in the benefit assigning. Finally, this article put forwards the countermeasures and suggestions for land acquisition compensation practice problems of Changsha City from improving the system of property rights, perfecting the compensation mechanisms and regulating land behavior. Among which, the cause analysis of Changsha City's land acquisition compensation and the countermeasures are the emphasis of this paper. Eventually, on the basis of summing up experiences at home and abroad of the land acquisition compensation, this paper puts forward improving the system of land property rights and establishing flexible standard system of compensation which will suit to Changsha City's economic and social development. It is of great realistic significance for the reasonable settlement of Changsha City's land acquisition compensation, and this is also the innovative point of this thesis.
