Residence, which is a basic requirement for man to survive and develop, is an object of basic human rights. Viewed from objective reality, the low-and middle-income families are the objects who really need residential right that is ensured by social security. Only these people need social security system to ensure themselves an opportunity to obtain suitable habitat condition. But how to ensure the low-and middle-income families the residential right is not only a big problem for many governments to deal with, but also regarded as a factor affecting political stability. Therefore, many countries have made long-term efforts to grapple with this problem. Meanwhile, China has been seeking for solutions constantly. According to the State Council "the announcement of advancing the housing system reform and speeding cities housing construction" in June 1998, the housing material object assignment should be stopped. Since the State Council abolished the welfare housing system, the city residents in our country have tackled housing problem depending on the market. However, the historical experience of the developed countries shows that resolving the housing problem for the low-and middle-income families only by market is not completely efficient. It should recur to preferential policy and intervention from the government. Every country has respectively set up corresponding public housing system to solve this problem. At the same time, our country has set up economically affordable housing system correspondingly.Lanzhou, as a capital city of inner China, is a city with a backward economy and high proportion of low-and middle-income families. The economically affordable housing system, as a basic system to resolve the housing problem for the low-and middle-income families, has solved many problems for the struggling homeowners and contributed to containing the market since it was carried out. However, investigation of the current status of economically affordable housing in Lanzhou reveals there are lots of problems during operation, such as high cost of government's policy, shortage of supply, remote location and so on, which are obstacles to the normal operation of the economically affordable housing system. Therefore, it is necessary to reform and perfect the economically affordable housing system in Lanzhou, and to ensure a more effective role for solution to revolving the low-and middle-income families' housing problems.This essay can be divided into four sections:The first section: Overview of economically affordable housing system. Firstly, the author explains the concept and types of economically affordable housing clearly. By comparing the economically affordable housing and general commercial housing, it stresses three properties of the economically affordable housing: policy, commercial performance, supportability; Then the author reviews the history of economically affordable housing system in the reformation and analyze the tendency, through the documents about housing system issued by the State Council throughout the period of reform.The second section: Legislation, practice and revelation of system for public housing abroad. The author chooses several representative countries or regions resolving the housing problems for the low-and middle-income families as the typical examples. By comparing and analyzing the origins and features of their public housing systems according to their classifications, The author proposes some principles of perfecting the economically affordable housing system, which are worthy of using for reference.The third section: Investigation of the current operation situation and problems of economically affordable housing legal system in Lanzhou. Based on the background of the current operation situation of economically affordable housing system in Lanzhou, we carry out empirical analysis by using the statistical data and our actual survey. The empirical analysis shows that since the system was carried out, it has significantly met the demands of purchasing by the low-and middle-income families, stimulated the consumption, contained the market, improved the urban environment and so on. Therefore, this system has been welcomed by the low-and middle-income families. But many problems appear during the operation, such as high cost of policy, runaway of door area, runaway of targets for selling, shortage of supply, inappropriateness of location. On the basis of the Section 2 and Section 3, the author put forward on some legislation proposals to reform and consummate our regime, such as to improve legal system, to establish lower prices in the land use right , to perfect the procedures to buy the economically affordable housing, to make the legal liabilities more strict, and so on.
