Research On Legal Protection Of Grain Safety

Grain safety means grain production,circulation,reserve and consumption accord with the law, can control grain venture and keep balance state of grain-supply and grain-demand. Our country always exists grain venture, which challenge the ability of grain security protection.Grain safety of China depended on administrative strength and governmental policy for a long time. But this traditional method not only ignores goods attributes of grain and hinders the basic role of market allocation, but also exacerbated the defects of governmental policy which is used to safeguard grain safety, can't solve the problem of disorder in the grain industry. We have to change the traditional method under the grain venture increasing background. Using law to protect the grain safety should become the new method, because law has character of determinacy and stability. In the modern China, the new method is feasible. The background of"rule by law"and the present condition of grain supply support the new method.Because of the traditional method, the current security law of grain safety has many flaws in legislative guiding ideology, form and content. In order to establish perfect grain safety system, we should adopt various measures. Firstly, set up new grain safety protection concept, using law to safeguard grain security. Secondly, strengthen grain safety legislation and establish perfect legal norm system of grain safety. The current security law of grain safety should be integrated and revised. Thirdly, enacting grain safety security law, which is basic law of grain safety. Fourthly, improve the protection systems of grain production, circulation, reserve and consumption.
