The Research On Trade Associations' Some Problems Of Economic Law

With the fast economic and political reform in our country, the function of trade associations in the process of the society developing become more and more obvious. On the one side, it needs trade associations to undertake some social responsibilities for political system reform and governmental function change. On the other side, it needs trade associations to play particular part for market economical and civil society development. Speak from this meaning, launching the theories research to the trade associations not only has the important theories and realistic meaning to our country economy, but also to our country's democracy legal system construction. In fact, the concern on the trade associations of the law field is not enough. Meanwhile, trade associations have many problems because of historical and systemic reasons. One of reasons is that the law status of trade associations is not explicit. To sum up, academic research on trade associations become more important than ever in our country.Comparative study method, synthesize study method and ratify study method were used to study the trade associations in this article. Based on the principle of the economic law, combining the economics, the sociology and the law knowledge, the author discuss the trade associations'some basic problems concluding the trade associations'basic theories, the economic law status, the present condition in our country, and the suggestions to perfect the trade associations'system. The author put the trade associations into civil society circumstance and the market economy at first. And review the history progress of the trade associations. Based on the development condition of the trade associations, the author also define the law status of the trade associations. At last, confronted with the conflicts between the actualities of the trade associations and the business situation around the domestic and international, and the expectations of the society, in order to construct and perfect the system of our country's trade associations, the author give some suggestions on the law-making and other aspects.
