In the new century, as economic globalization, science and technology globalization, financial globalization and trade liberalization, the acceleration of the trade liberalization, the importance of the intellectual property has been becoming increasingly prominent. The role of knowledge on economic growth is vital, during the time of knowledge-based economy, intellectual property rights is not only an assets protected by the legislation, it also has become the most important business intelligence resource. It is a competitive advantage of companies: as a powerful business tool, intellectual property rights connect R & D and marketing, and it is the growth point of companies'value and profits. And it is also the key to build the business vision for companies. In uncertain technological and market environment, technological innovation plays an important role to maintain our competitive advantages. The intellectual property helps companies to obtain competitive advantages, since it comes from technological innovation. Commercialization of intellectual property indicates the value of intellectual property, thus to improve the ability of companies'commercialization of intellectual property can promote their competitive advantages.At present, the strategic position of the intellectual property rights becomes much higher as Chinese enterprises have paid more attention to the intellectual property rights capacity. However, the innovations of most of our companies and research institutes haven't become profits. Generally, the commercialization of intellectual property rights is still fairly low in China which is with great potentials to grow. As Chinese companies will fight with the foreign companies directly after we joint in the WTO, and the focal point of the competition is the amount and the quality of proprietary intellectual property rights.This paper studied the factors which can affect the companies'ability of commercialization of intellectual property rights, based on foreign and domestic researches and through theoretical analyses, building models and instance analyses. In this paper, we analyzed the relation between the commercialization of intellectual property rights and the competition advantages, and built the model which reflected the former influence factors. We show how the influence factors act on the companies'ability of commercialization of intellectual property rights. Then we studied the significance of it to form the companies'core competitiveness and improve their competitive advantages. This paper provides theoretical foundation for the enterprises to improve their capability of commercialization of intellectual property rights correctly and administer the intellectual property rights. We made pointed reference of the strategy for companies to improve their ability of commercialization of intellectual property rights with instance analyses.
