Intellectual Property Protection And Research Of Gem Listed Companies

Intellectual property is a critical strong point for public companies. As an important factor in the rapid development of companies, it is even more important for innovative small and medium-sized enterprises. And the location of China's Growth Enterprise is letting a large number of outstanding innovative corporations enter the Growth Enterprise Market (GEM), which meets the features of 'Three High and Five New'(High-tech, High Growth, High value-added, New Economics, New Industry, New Energy, New Material, and New Service Industry). These features all share close relationships with intellectual property. However, after coming into the market, many companies suffered from decline in their performance due to various reasons, which produces negative influence on the health of GEM.This article aims to discuss the method of maintaining the health of sustainable development of GEM from the angle of intellectual property. It is divided into four chapters:in the first chapter we mainly discuss the relationship between GEM Companies and intellectual property, and we also point out the distinctions in intellectual property requirements between GEM Companies, other innovative small and medium-sized companies and Listed Companies; in the second chapter, by analyzing the prospectus of 186 GEM Companies from October 2009 to March 2011, we summarize the present situation of intellectual property of GEM Companies in China, both from microscopic and macroscopic aspects; with the help of above analysis, in the third chapter we summarize the problems in the protection of intellectual property of GEM Companies, and give analysis both from the aspects of legislation and protection mechanism。The legal aspects raise the problems of the low standards of access to intellectual property rights in the board market, not strictly required to refund, not complete mechanism protection, and low standard for affirmation of high and new-tech enterprises. In respect of mechanism protection, the main problems are not complete management mechanism, continuous weak innovation ability, deficiency in intellectual cultural property rights and bad service in intermediary organs. In the fourth chapter we summarize the problems of its own legislation, enterprises, intermediary organs and society in public areas and also point out the suggestions of improving intellectual property rights and related problems in the GEM Companies, for the purpose of the sound development of GEM Companies.
