The dramatic change in modern society of China has directly resulted in Chinese cultural development from its content to structure. This also leads to the fundamental transformation in the whole educational system and models. With the advent of western culture in late Qing Dynasty and beginning Mingguo Period, opening classes and building schools became a fashion. To ensure the regulation of schools and their scientific development, the government in Qing Dynasty issued some relevant educational law regulations. With this new policy, musical education in schools, being an important part of education, came to receive the attention and concern from the government and many forerunners. Meanwhile, China embarked on the construction of musical educational law regulations in schools. In order to meet the talent requirements in social change some improvements were made concerning educational law regulation at the beginning Mingguo Period. This thesis is intended to make a macro, organic and dynamic theoretical understanding of the musical educational law regulation construction in schools at the phase of late Qing Dynasty and beginning Mingguo Period after having analyzed numerous literature reviews, and finally to provide an objective, critical and historical comment.This paper consists of five parts: in part one, research questions are raised, and descriptions of research subjects and scales, literature review and creativeness are provided; Part two expounds on the historical background and the main contents of law regulation construction. Specific samples are provided and analyzed concerning musical educational law regulation in schools of late Qing Dynasty and beginning Mingguo Period in part three. In part four, some exploration on the property of musical educational law regulations in schools, its systematic structures, regulation goals and features, etc. In the fifth part it concludes that the musical law regulation construction in schools of late Qing Dynasty and beginning Mingguo Period has a far-reaching impact on and illuminations for the future generations. The significance of this thesis is illustrated here as well.This research has made an objective and micro analysis of the research theme on the basis of the guidance of Marxist Materialism, the integration of theory and practice, history and logic, and the applications of literature review, induction, deduction, case study, systematic analysis, etc. Research indicates that the musical educational law regulation construction in schools of late Qing Dynasty and beginning Mingguo Period met the need of social development and made significant and far-reaching impact on the modern musical education of schools in China. It shows that law regulation construction is of great significance and value to the subject development. In other words, musical instruction in schools of China can not go smoothly without the protection of law; nor can its development be imagined.
