Judicial instruments are an important type of legal documents. They include all kinds of instruments which have legal effect, legal meaning or legal value and are made, used or submitted by judicial organs such as the public security department, the people's procuraterate, and the people's court and non-litigious organs, parties involved and the agents thereof in accordance with legal procedures, legal facts, laws and rules in litigious activities or non-litigious activities which is related to litigation.Traditionally, both at home and abroad, the linguistic approach is adopted in legal translation studies, in which legal translation is only regarded as a process of linguistic trans-coding. This approach emphasizes the "equivalence" between the source-text and the target-text by only analyzing certain intra-textual factors such as lexis and sentence. However, in the whole legal translational action, the translator is actually in a decision-making process, from the pragmatic level to the lexical level. Therefore, the translator should not only consider every intra-textual factor influencing his decision but also all relevant extra-textual factors.This paper gives an in-depth text analysis of judicial instruments on the basis of Nord's model of translation-oriented text analysis. By analyzing the intra-textual and extra-textual factors of the judicial instruments, the author finds out some translation problems. And according to the results of text analysis of the judicial instruments, this author also proposes translation principle to overcome these translation problems.
