On The Perfection Of Citizen 's Participation In Administrative Accountability Procedure

With the development of China’s reform of the administrative system, the administrative accountability system from the "storm" accountability to the normal accountability, from administrative accountability to procedural accountability. Citizen participation in administrative accountability as an important part of the administrative accountability system, although has been in practice is more and more used, but it still has research theory is insufficient, the law is imperfect, lack of program specification. This paper from the citizen participation in administrative accountability procedures of construction, using the literature analysis method, comparative analysis method and system analysis method, expounds the present situation and the dilemma facing China citizen participation in administrative accountability procedures, in reference to foreign related civil participation in executive asked responsibility set based on the experience, combined with China’s the development of practice, proposed further consummates our country citizen participation in administrative accountability procedures are proposed, to promote citizen participation in administrative accountability legalization, standardization, system development. The main structure of this paper include:The first part:introduce the basic outline of citizen participation in administrative accountability procedures ask. Mainly includes three aspects:one is the provisions of the laws and regulations of China concerning administrative accountability procedures, especially the; two is the introduction of China’s citizen participation in administrative accountability of traditional mode and network mode of practice development; three is the practical difficulties of citizen participation in administrative accountability procedures:the law is not perfect, link setting unreasonable, information disclosure is not in place, relief mechanism is not perfect etc..The third part:Perfection of citizen participation in administrative accountability procedures advice. This part includes three aspects:one is the foreign experience of citizen participation in administrative accountability system, analysis USA, France and Germany experience of citizen participation in administrative accountability hearing system, legislation, institution building and remedy ways. Two is to improve our country’s citizen participation in administrative accountability procedures follow asked guiding principles:the principle of due process, the principle of extensive participation principle, fair and open principle, clean and efficient. Three is to improve our country’s citizen participation in administrative accountability procedures are proposed:establishing and perfecting the laws and regulations and supporting system; perfect the key link and program settings; full implementation of information disclosure; and improve the accountability of relief program.
