Islamic state occupied vast territory in Iraq and Syria in 2014. They killed hostages, prisoners of war and civilians randomly and cruelly. Also,they prostituted the so-called “pagans”, destructed historical monuments,and attracted “Jihadists” all over the world by social network. All of those create serious impact on worldwide anti-terrorism security situation.This paper studies the background, development and characteristics of Islamic state, and analyze the nature and status of “Islamic state” from the angle of law. This paper compares the similarities and difference of terrorist organizations between Islamic state and traditional countries. It also concludes that the nature of Islamic state is extreme terrorist organization. Based on those, this paper discusses how to regulate Islamic state from the angle of international law. First, it talks over the question of whether Islamic state could become a subject of international law.From the angle of sanction, international law personality could be partly given to Islamic state. The last part of this paper elaborates how to govern Islamic state within present international law, and discusses it from the views of international humanitarian law and international anti-terrorism law. |
