On The System Of Community Correction In China And Its Perfection

As for the researches conducted on community corrections, western countries have longer histories than us and thus accumulated rich practical experiences, which have become a very important non-custodial sentencing enforcement in the criminal justice system nowadays. Although the community corrections program has a short time of development in China, the Chinese law experts have clear understanding on the extreme significance of community corrections. The community corrections program will help rehabilitate the offender, making their returns to society easier, it is also beneficial to social stability and unity, as well as prosperity and stability of the country. Based on the theories and practical experiences of domestic and foreign countries, a detailed research was conducted on the community corrections that have been implemented in Panlong District of Kunming City, current issues of community corrections have been brought forward, and reflections and recommendations on perfecting the community corrections system have been elaborated in the paper.This paper is structured in 3 main chapters:(Ⅰ) stated the understanding on the concepts of community and community corrections, and exploratory definition and reflection on the nature of community corrections; discussed the inevitable existence and development of community corrections from four aspects respectively; (Ⅱ) theoretically described the current status of community corrections in China and reflected on its development from legislative and judicial levels,based on the experiences from Panlong District and national pilot programs, conducted analysis and research from both the macro and the micro perspectives on common problems existed in current community corrections system; (Ⅲ) based on the research data, analyzed the current status of community corrections, discussed the common problems in current community corrections system in China, and elaborated the recommendations on improvements of community corrections system.
