With the development of the market economy in China and the improvement of people’s living level, to establish a diverse health care system which covering both urban and rural residents has become a ultimate goal of our health care system reform. Although, China’s medical security system has been initially formed, but so far the relevant laws and regulations are relatively backward especially local laws are rare indeed. However, legal protection is the the basic of our health care system function effective uninterrupted and smoothl. As an important part of the entire legal system, local rules and regulations about medical insurance system largely determines whether a good run. Therefore, this article concentrates on health care legislation of Jiangsu Province, analysis some problems and propose some measures which learned from other provinces’s experiences, really hoped some ideas can be useful in refining the health care system of Jiangsu Province.This paper is divided into four parts. The first part is a theory part, theoretical analysis the concept, the function and the basic principles of local legislation of health care.On the second part, by combing the legislative development history and the current achievements of Jiangsu medical security system, we found that there are some problems, such as lagged law of health care, lack of institutionalized arrangements to narrow the gap between urban and rural areas,lack of public participation and supervision, those became the obstacles of establishing a more unified and fair medical security system in Jiangsu. On the third part, by comparative analys the health care legislation of other provinces, I summarized the common characteristics and several local legislation trends, Guangzhou and Shenzhen some specific measures has been discussed. In view of the above conclusions.The fourth part suggests six measures to slove those problems above:improving the legislative level, perfecting the laws and regulations, broading people’s means to participate in legislation and developing commercial insurance.
