Investigation And Research On The Implementation Of National Law In Qingshan Village Of Miao Village In Southeast Guizhou

The method of article is field investigation.I have followed my research supervisor Mr zhou to investigate the qingshan village,xinqiao village and zhangao village located in leishan county Guizhou province.In the research about the operation of the law in qingshan village where the Miao nationality inhabits.I found the combination between the law and the native custormary law.The national law don’t operate as the same as other province,it really operate according to the native condition. The article have four parts.The first part is Introduction.It is about the meaning and method of the article.The second part is the Civil law’s operation in qingshan village.The main influence of civil law is property and marriage.Because the village have local punishment of property law.So there are some differences between the Civil law and the custormary law.In addition,there is a complete custormary marriage law in the Miao nationality inhabits,No matter from the process of get married to the divorce.So there are so many differences to our country’s marriage law.But with the legal construction developed,the custormary law changed,it get closer to the civil law.The third part is description about the village self-governance in qingshan village,it have three parts include local Yilang system,village regulation and the villagers’ democratic supervision.The village self-governance have big difference to the other place in the country.it have special custormary self-governance,which combine with the village self-governance law,So it have different influence to the tipical Han nationality inhabits.The fourth part is discussion the relation between the national law and the custormary law.I analyzed the conflict between the national law and the custormary law,and explore the value and concept of custormary law,then tried to find the reason of conflict,at last found a way to coordinate the national law and custormay law,in order to make a good use of them.
