On China's Educational Status And Role Of Trade Unions In Protecting The Rights And Interests Of Teachers

The purpose of this thesis is to probe into the status and function of teacher union in protecting teachers' rights and interests .On the premise that the reformation of school personnel system deepens increasingly and new labor union law publicizes currently in our country, to research the problem will help to deepen the reformation of teacher personnel system, to make the teacher union develop and perfect itself, to define the status and function of teacher union, and to provide new notion and theory basis for studying how to protect teachers' rights and interests.The study begins with analyzing the system of protecting teachers' rights and interests, and points out that teacher union is absent in the system of protecting teachers' rights and interests, whose effect is not good. The paper approaches the status and function of teacher union during protecting teachers' rights and interests through literature, legal-principle , comparing and annals. The results show the function of teacher union that performs in protecting teachers' rights and interests:(l) It is determined by the character of teacher union and laws of labor union . (2) It is the demand responding to educational reformation. Then, the paper is reviewing the development course of teacher union after liberation and its present phenomena, and analyzes the obstacle that affects teacher union to perform its function. Based on this, Part four of the paper mainly expatiates its mechanism that teacher union performs its function, teacher union performs its function by the system of intervention and protecting in advance, the system of equal negotiation and contract, the system of the staff congress and mediating the labor relation.The last part is dealing with the realization of the status and function of teacher union and providing some suggestions about exterior protection and inhered protection.
