On Accountability, The Judge

When it comes to rule of law, the role of independence of judicial powers is indispensable. While, it is realized that independence is not enough. It cannot necessarily lead to justice. As is well known that powers without border always rend to corruption. So powers must be supervised. While the supervision powers might influence the judicial powers as well. Thus it is necessary to balance the two powers. The author holds the view that the institution of judge responsibility is the way out.The assay, by the way of historical analysis and contracting analysis, examines the institution in our country and then give the suggestions of improvement. The assay is divided into 3 parts.Part one In the part the author by examining the evolution of the institution in our country and abroad, give a brief introduction of the institution. Then the author gives the meaning of the institution in the present age, its reasons and its prerequisite and conditions.Part two In the part, the author contracts the institution of different countries and comes a conclusion that the common points reflect in two sides. One is that the institution includes both the behaviors related to trial and the behaviors beyond courts. The other is that they all have specialized organ of investigation and process.Part three The author points out the problems of our institution and then tries to give the way to solve the problems.
