On The Perfection Of Old-age Insurance In China's Legal System

Endowment insurance plays an important role in the system of social security, each country in the world pays much attention to the construction and development of the system of endowment insurance. Our country is an underdeveloped country with many people which has heavy burden to provide for the aged. The data of the fifth census shows that the total population of our country has approached to 1300 million in which there are 132 million people whose age exceed 60.The number of the aged accounts for 10.4%. According to the standard of aging country which fixed by the UN—10%,our country has turned into a country with too many old people. At the same time, the changing of economic system and the reform of state corporations demand better work from the endowment insurance. Our government and people pay much attention to how to solve the problem to provide for the aged in face of challenges and pressure. It is not only a economic and social problem but also a legal problem. A series of problems which appear in the process of the changing of system of endowment insurance are studied in this article. In the basis of learning from other countries and exploring the reasonable establishment of the system of endowment insurance, the author analyzes the development of the system of endowment insurance in our country.This article consists of four parts:The first part mainly introduces the current legal system of endowment insurance and the problems of it in our country, and explains the necessity of the perfection of the legal system of endowment insurance. Firstly, the actualities of the system of endowment insurance in our country are summarized, which involve two aspects: town and country, a series of problems which exist in the system of endowment insurance are pointed out; secondly, the problems which exist in the current legal system of endowment insurance in our country are analyzed.The second part introduces legal systems of endowment insurance of other countries in the world, which includes three aspects: the international trend ofendowment insurance, the main kinds and characteristics of legal system of endowment insurance of other countries in contemporary world. The author expects they have something available to the perfection of the legal system of endowment insurance in our country.The third part mainly expatiates how to establish a reasonable system of endowment insurance according to the actualities. It involves two aspects. Firstly, to design the macroscopical policies of the system of endowment insurance; secondly, to enact the development target of the system of endowment insurance. The design of the system of endowment insurance in this part establishes the base for the analysis of the development of legal system in the forth part.The forth part is the emphasis of this article which discusses concretely how to develop the legal system of endowment insurance. It involves two aspects. Firstly, to establish the legislative mode of the legal system of endowment insurance; secondly, to discuss in detail the development of the legal system of endowment insurance in aspects of raising funds of endowment insurance, management of funds of endowment insurance, supervision of management, mechanism to solve disputes.
