The Quality Of Civil Law In The Rule Of Law In The Process Of Modern Research

We are in the historic proceeding of realizing modernization. Modernization is a process of changing the society from traditional to modern. It is an important content that we construct the state ruled by law and realize the nomocracy. Some factors affect the speed of nomocracy's construction, such as economic, politics, culture, society and so on, but the citizen's legal quality is the important one. The citizen's legal quality is the cognation of law which formed in the long-term social life, and formed the action habit & ability based on it. It is a conglomerate that contains three dimensions, such as cognation of law, conscious of law and action of law. It is composed of twelve elements. The modernization of the citizen's legal quality relevant to the nomocracy, it is the rooted spirit factor and demand to be suited for the nomocracy's requirement. To promote the legal quality is the fundamental task to construct the state ruled by law and realize the nomocracy. Therefore, it is so important to research the modernization of citizen's legal quality with the view of Sociology of Law.Following the current requirement of "building a socialistic nomocracy's state" and using the basic principals of Marxist Law, basing on the last research result, using the technical manner of documentary and empirical survey, we research this problem from theory to practice deeply under the sight of nomocracy. We define the concept and feature, represent its immanent content and realistic denotation. We reveal the logical relation between nomocracy and modernization of citizen's legal quality, it is said that the nomocracy supply the endless power to develop the legal quality and the legal quality is the basic condition to reach the nomocracy. We find the distance by analyzing and offer a strategy. We should improve the legal system to create a better internal environment; we should develop all kind of construction to create a better external environment; we also should explore the new model of legal education to enhance the power of pushing the modernization of citizen's legal quality. Through these ways we can accelerate to realize the state ruled by law.
