Vulnerable Groups, Civil Protection System Theory

With the further development of the market economy and the sharply shift of the social structure, the vulnerable groups problem becomes one of obvious risky elements affecting the stability and development of society and one of the key problems of sustaining development. Private rights are very important to vulnerable groups because of their weak trend, and civil action can provide the strongest relief for them. Therefore, it is very important academic and realistic significance to study the currently principle and mechanism of civil procedure protection for them. The author is of the opinion that we can give the vulnerable groups more inclining protections by establishing and improving present civil procedure law, and it is very reasonable and necessary.This paper is characteristic of interdisciplinary study. During the course of writing the author studied and absorbed the research techniques of a lot of disciplines, such as sociology, psychology, politics and so on. By the analysis of integrating theory with demonstration, comparative and inductive means, this paper attempts to probe into the solutions to the problem of social vulnerable groups in China through the building of civil procedure protection mechanism。This paper consists of three parts with about 300,00 words except the foreword and the epilog, as its main content and framework as follows:Part I focuses on the connotation and extension of vulnerable groups in the scope of law, and it is different with traditional sociologic definition. The research object of our paper is social vulnerable groups, which is in the weak trend because of some social system reasons. Upon this, the author analyses the characters of the vulnerable groups in civil action, so that we can provide more active protection. This part also presents the necessity that legal protection urgently needed in China and the justifiability of giving the vulnerable groups inclining protection in civil action.
