Improve Our Tourism Services Trade Legislation Discussed

International tourism has played a more and more important role in China's economic growth. Since the 1990s, the tourist industry has achieved great developments. However, the legal system concerned with tourism still falls behind. Although the related governments have set up some concerned tourist laws and documents, which have contributed greatly to our tourist developments, construction of tourist law has some lagging. After China joins WTO, it is necessary to consider how to deal with such problems in the field of tourist market. The resolution will necessarily profite trades abroad and realization of tourist powerful country and enforce the position in overseas trade system. The tourist industry must abide by WTO rules and perform promise of further opening-up, deal with properly trade friction, clear up tourist developing barriers, and realize gradually freedom of tourist trade. Juse under such background, we should strengthen law construction in our country, tourist law coordinated with WTO in our country.This thesis is divided into introduction, main body and conclusion, in which the main body includes four parts.The first part mainly studies on a general introduction of tourism and international tourism service trade; in view of this, the paper puts forward some private ideas.The second part elaborats the tourism trade in services under the "General Agreement on Trade in Services" (GATS) in WTO, as well as our Specific commitment and Horizontal of commitment. On the basis on summarization to the current legislation situtation of tourism in our country at present, the author analyzed the problems existing in the legislation of tourism in our country.The third part is the legislation of tourism in overseas and reference in our country, through the comparative study of legislation in Japan, America, Singapore and England, summarizes some advanced legislation experience in these countries. The fourth part is about legislated completion to our tourism, conceives the content in fundamental tourism law and proposals to improve the "Travel Agents Law", "Guides Law", "Hotel Law","Touriam Consumer Protection Law" and other single law, as well as the methods to perfect the tourism contract system and the touriam consumer protection system.Based on the GATS market access, of WTO non-discriminatory treatment, the principle of transparency in the field of tourism, as well as our Specific commitment and Horizontal of commitment, comparing the advanced experience in legislation in tourism-developed countries, in-depth analyzing the problems of tourism legislation, in accordance with the specific situations of tourism legislation in China aiming at regulating and adjusting the development of tourism, on the permise of not violating the legal principle of WTO, this thesis puts forward some suggestions on the perfection of tourism legislation in China.
