Control And Interaction: Political Vision Of Grassroots Democracy

The social basic-level governance is always an important issue which related to the national governance in Chinese history. Today, the construction of local democracy of which the self-governance is the core system has enormous effect on the process of democracy and rule of law in China. Writer hereby is planning to give a theoretic discussion about the contemporary local democracy in china from the view of jurisprudential and political.In the 20th 70', with remarkable changes in national economy, politics and cultures, the system of local democracy in china was set up and started its practice. No matter the residents' self-governance in urban area or the villagers' self-governance in rural area, they all behaved lively and vital from the beginning, and seem to be strong powers that originated from the basic-level of society to influence the superstructure.Take the urban community self-governance as the example. With the development of urban community construction in china, community residents' self-governance originated from 1990s. It is the realization form of urban local democracy, by which the urban residents can directly manage their public affaires in community according to law. The community self-governance plays a positive role in Chinese urban community's development; simultaneously it helps to make a change in the way of urban local governance in China. The point is that, the reform of urban real estate in the past 10 years has created a crowd of citizen who possess their own real property. They establish condominium associations to protect their rights and interests in a lawful and democratic way. In one hand, their actions can promote our constitutional construction; in the other hand, they also become a strong motive power to push on urban politics and local democracy.The locus of the development of urban community self-governance clearly reveals that the local democracy in china has experienced a process of from "unilateral control" to "mutual effect". The embarrassment it has confronted with can also be a suggestion that without the circumstance of democracy of the whole country, the local democracy hardly can break though the simple mind of "control", hardly can realize the real democratic politics.In author's opinion, the crowd of citizen, the democratic way they used to protect their rights and the public discussion they join in are all good chances for Chinese national democracy. There should be a place in our law for the condominium association, and regulate its' organization and behaviors. That means take the local democracy seriously; make it a behalf of social power. We can finally build a "strong state" and a "strong society" which have a mutual effect to each other, and get guarantee from democracy for our process of rule of law.
