This paper focus on marine illegal immigration. At first the paper will give the definition, classification and characteristics of marine illegal immigration. Then it will make an analysis on the characteristics and defining means of done and undone marine illegal immigration, and make sure who are the parties of marine illegal immigration, and which kinds of rights, obligations and responsibilities they have. The following part will systematically analyze and summarize the civil, administrative and criminal legal relationships after the action of marine illegal immigration. The category of the expenses, its burden party and claims of insurance are discussed on the civil parts. Different administrative liabilities and criminal liabilities on different behaviors of marine illegal immigration are separately analyzed according to the laws and regulations in China. Rooted from the practice, the international treaties and the laws in China, this paper makes every effort to systematical analyses and summarizes the involved legal aspects of marine illegal immigration and hope that it is helpful to the practice.
