Government Information Disclosure System Of The Rule Of Law

In the modern society, the government information public is considered as an important content of democracy and rule of law, and is unceasingly approved by the various countries'constitution and laws. On May 1, 2008, "Government Information Public Rule" became effective, which promotes the disclosure of China's government information public system. However, on one hand, the legal position step to be excessively low, the conflict of laws to be serious and the imperfect of law content and so on questions still exist in China; on the other hand, in the recent two years, some cases about government information public that have the widespread influence in the society appear frequently, which is urgent to perfect the government information system.Facing the problems of government information public, we mainly try to perfect the government information public as the breakthrough point from the angle of view rule of law, which attempts to provide the essential reference for perfecting the China's government information system rule of law. This article is fully divided into five chapters. The first chapter is the introduction, which draws out the research question through the"The Southern Chinese Tiger Event"and the event that Yan Yiming Applied for disclosure of financial information and 4 trillion economic stimulus plan, and gives a brief introduction to the research methods and primary coverage of this article. The second chapter is the theory outline of the government information public system rule of law. Through the discussion on the basic connotation, the rationale and the connotation of government information public rule of law, we elaborate rationale and the direction of advance of the government information public system rule of law. The third chapter is the present situation and the problem analysis of China's government information public system rule of law, which analyzes and induces problems existing in the China's government information public rule of law from the law and practices. The fourth chapter is comparison to the outside of territory the government information public system from the legislative pattern and the present situation, which concludes the suggestions to perfect the China's government information public system rule of law. The fifth chapter is the suggestions to perfect the China's government information public system rule of law. Through perfecting the framework of laws about China's government information public, that is, Right to know entering the constitution, establishing the related laws government information public, we solute the current problems of government information public, and realize to provide the references for perfecting the government information public system rule of law.
