Research On The Evaluation Index System Of The Law-governed County

"County governance,world security." The county has always been the most basic and stable level of our country,county governance plays an important role in the governance of the country in the same way,the construction of the law-governed county is also an important part of national development and the foundation of the rule of law.It is of practical significance to take the county as the logical starting point.With the construction of rule of law in China entering the bottleneck stage,the exploration of new mode of rule of law is inevitable.The rise of rule of law evaluation is a breakthrough in dealing with the dilemma of rule of law in a way.Therefore,from the perspective of building a law-governed county,this paper designs a set of feasible evaluation index system about the rule of law by defining the target of the evaluation index of local rule of law,coordinating the basic requirements of the rule of law and the relationship between the rule of law and the local characteristics.This article is discussed from four aspects.The first part is the theory of building the evaluation index system of the construction of law-governed county.The relevant theories are discussed in three aspects.First,the transformation of the concept of the rule of law.In other words,the concept rule of law transform the original "abstract definition" into concrete practice of "definition",and put forward specific requirements for the practice of "definition",to ensure operability of indicator design;second,the position of the law-governed county in China's legal construction.This paper makes a general combing of the connotation and characteristics of the law-governed county,and summarizes the important position of the law-governed county in China's legal construction from the perspective of the nature of the rule of law,the structure of the political law and the motive force for the development of the rule of law.Third,the construction principles of the evaluation index system of the law-governed county.It mainly includes the principle of combination of unity and locality,the principle of combination of qualitative and quantitative,the principle of combination of government active guidance and mass participation,comparability and operability.The second part is the domestic exploration and Practice for the construction of rule of law evaluation index system,this part mainly introduces the related legal practice in the construction of domestic index system design,analyses and solves the problem existed in current practice such as the definition of chaos,the content and structure of the lack of reasonable,specific operations such as lack of science,in view of the existing problems,three suggestions are put forward.First,to define the definition of relevant concepts.The concept is the premise of a clear understanding,through the comparison of the index system for the evaluation of the rule of law and the evaluation index system of rule of law construction,evaluation of local rule of law construction and the concept of government construction evaluation by rule of law,finally,the definition of the evaluation index system of the rule of law construction is summarized,and the connotation and extension of the concept of the evaluation index system of the construction of the rule of law is clearly defined;second,to determine the basic target design.this part determines the idea of rule of law about "Protecting Private Rights and Limiting Public Rights".Index design includes both the similarities and local personality,to balance rule of universality and individuality,and combine the two kinds of logic form design will form a complete target design;third,to standardize the specific practices.The design of the evaluation index system is more feasible from the perspectives of the multiple selection of the evaluation subjects,the acquisition of data collection at the source and the improvement of the evaluation procedure.The third part is the mode selection and basic framework of the evaluation index system of the law-governed county.Based on the exploration of the theory and practice of the evaluation index of the law-governed county,we choose a certain mode to design a general evaluation index system framework of the law-governed county.This part firstly makes a typological analysis of related modes,and distinguishes management mode and governance mode from the perspective of evaluation subjects,evaluation results and evaluation implementation,so as to clarify their connotation and scope of application.The author believes that although the two have a special scope of application,they should not be strictly differentiated.On the one hand,the purpose of both evaluation is common,and in the specific evaluation process,it is possible to achieve the vertical convergence of the two assessment modes.On the other hand,the two assessment modes reflect different stages of logical access,which can achieve horizontal collaboration between the two assessment modes,and establish an assessment mode that focuses on governance-based assessment modes and supplements management-based assessment modes.Secondly,this part designs the basic framework of index system construction of the law-governed county,based on the rule of law construction subject,it designs 6 first level indexes,including giving full play to the functions of the people's Congress,adhering to the leadership of the party,the construction of the government under the rule of law,promoting judicial justice,public legal literacy and common construction of social organizations.Based on the responsibilities,obligations and laws of construction,it establishes 26 two level indexes,and 26 indexes are further refined to improve the quantification of indicators.Finally,this section briefly summarizes the logic of the evaluation index design for the construction of the law-governed county,and provides reference for the reference.The fourth part is the specific operation of the evaluation index system for the construction of the law-governed county.This part carries out the procedural design for the evaluation preparation phase,the evaluation preparation phase,the evaluation response phase,and forms a complete and practical the design of evaluation index system of the law-governed county.Specifically,in the evaluation preparation phase,the purpose of the evaluation should be clearly defined first,the evaluation work plan should be formulated,and the purpose of the assessment determines the direction of implementation.The author positioned the evaluation purpose as "restricting public rights and protecting private rights",which will guide the construction of the law-governed county.The evaluation plan is the guideline for the entire evaluation.When formulating the evaluation plan,the plan should be as detailed as possible in terms of the problems to be solved,the methods and procedures for evaluation,and the nature of the relationship between the evaluation entity and the legal entity.In addition,the subject of evaluation must be determined.There are inherent defects in the mode of governmen-led and multi-stakeholder participation.Therefore,according to the local conditions,it may be considered that Standing Committee of the people's Congress in county took the lead and the participation of relevant stakeholders to jointly conduct the evaluation of the rule of law.Besides,select index weight calculation method.By analyzing the procedures,the advantages and disadvantages of the Delphi method,the analytic hierarchy process and the direct assignment method,the weight design method based on the AHP method and the Delphi method is finally determined,and the related assessment software is also considered to achieve the stability,durability,and scientificity of the evaluation.In the evaluation implementation phase,it is primarily necessary to ensure the diversity of data collection and determine the evaluation scoring standards.According to the different characteristics of the index and the order of value,the standard of scoring is designed.Second,organize,feedback,analyze and evaluate information to make conclusions,explain the results,and provide reference for the construction of law-governed county.Finally,submit an assessment report and publicly announce the results.The assessment report should be as concise as possible,including the complete assessment content.The report should be open to the public and form a positive interaction with the citizens.In the evaluation response phase,it is necessary to establishing a legal system construction assessment database in order to facilitate future data comparison and promotion of evaluation projects.What's more,a corresponding mechanism should be established to guarantee the evaluation results and ensure that the construction subject analyzes the content thoroughly instead of evaluating in a form.Finally,a feedback mechanism for evaluation and supervision is established to form the double supervision mode of evaluation work and construction work,so as to improve the logical chain of the evaluation system.
