The crime is the universal existence phenomenon of human society. For several thousand years, the scholars have carried on studying the criminal phenomenon, and have made rules to resolve disputes and punish criminality. Along with the enhancement of social civilized degree, more and more people realize that it is an inescapable responsibility of government to solve the criminal problems. Humanitarian concern over criminal law has become an important earmark in the development of modern penal law. In terms of the trend of the socialization of criminal execution in the world, community-based correction has become a major manner for criminal punishment. It was based on profound and wide theories, originated in 60-70 years of 20th centuries in western countries. Adopting the community-based correction system can increase the self-discipline awareness of the persons serving sentences, and improve the quality of prisoners' reformation. In August of 2002, China started its partial experimental practice. Although a lot of achievement accomplished, it still had many problems existed. Form discipline subordinated, community-based correction should locate as a branch or research field of sociology and it involves pedagogy, psychology and policy study. But in China, it is classified in criminal jurisprudence system only. It is necessary for us to expand and deepen the breadth and depth of the research.In order to establish the newly community-based corrections that fit the situation of China, based on the practice of community-based corrections in Shanghai, the author has build up her own theory of community-based corrections. And wish this article can do its work in China's community-based corrections practice. That is the motive of this article.Apart from the preface and concluding remarks, this paper is divided into five parts, altogether more than 40,000 words among which the annotation is about 4,000 words. Chapter one: Discrimination of the concept of the community-based correction. Chapter two: The theoretical basis of community-based correction mainly from four aspects. Chapter three: The now-on practice of community-based corrections in Shanghai. Chapter four: On the humanist idea of community-based corrections. Chapter five: Reform and perfect the community-based correction system of our country.
