Administrative Responsibility In Food Safety Incidents Studied

In recent years, food safety incidents happen frequently in our country, not only endanger the life and health of the people, and threaten the country security, and also not incompatible with building a harmonious society. Repeatedly occurring food safety incidents is primary because of the illegal acts of the food procure suppliers, but also reflects another aspect, the weakness of China's food safety administration, it represents as, the shortage of the law of the food safety administrative liabilities, the poor charge of the responsibility of the personnel of organs of state. Now in our country the most of the studies are about the civil compensation and the administrative execution system of the food safety, few studies about the administrative liabilities in the food safety. For these reasons, this paper start from the administrative responsibilities theory combined with foreign legislation and practice, analysis the Administration responsible in food safety incidents.This thesis is divided into four parts. The first part starts from the theoretical and the constitutionalism foundation of the concept of administrative responsibility to be the theoretical basis for the thesis. The second part discusses and introduces the theory and practice of the food safety administrative liabilities in some countries, to afford us lessons. The third part makes a detailed analysis of China's existing administrative responsibility for food safety, to provide substantial basic information. The last and the most important part is to point out the problem of China's existence administrative responsibility for food safety and give some suggestion of how to build a rational system of food safety administration responsibility system.
