Analysis Of China's Wetland Protection Legislation

Wetland is a kind of important ecosystem on the earth, which Playing significant environmental functions and ecological benefits on climate adjustment, water conservation, water purification, pollutants degradation and maintenance biodiversity. The wetland resources in our country are plentiful and which possess the characteristics of various types, large quantity, wide distribution, significant area differentiation and abundant biodiversity. The wetland area of China is situated Asian first, world fourth. But we have long paid excessive attention to the economic value of wetland resources with an air of valued utilization and despised protection which results in serious damage to the Chinese wetland resources. It is urgent to protect the wetland resources of China. Since the 1990s, China has adopted a series of measures with regard to wetland protection and utilization which carry out the wetland protection and biodiversity to a certain extent. But due to the imperfection of legal system, the deficiencies in capital investment and the insufficiency of attention to the wetland ecological value, at present the wetland resources still have not been effectively protected in our country.This article intends to put forward the beneficial proposals of improvement in wetland protection legislation by means of the analysis on the existing problems and the present legislation situation of wetland protection. The full text is totally divided into three parts.The first part introduces the present utilization and legal protection situation of wetland resources. It analyzes summarily the existing problems and reasons of wetland utilization. It also analyzes the wetland protection legislation at the national and local levels as well as the policy planning about wetland protection.The second part introduces the foreign wetland protection legislation, and analyzes the methods of these countries on wetland protection for our reference.The third part makes reflections on the wetland protection legislation and puts forward some improvement suggestions in terms of guiding ideology, legal principles, management system, practical regulations and legal liability.
