The Civil Servants In China Study On Administrative Ethical Dilemma

In recent years, our country's theorists and academics have attached importance gradually to the study of administrative ethics in the period of contemporary social transformation, and have made some achievements in anti-corruption, administrative ethics system security, and the official moral construction. However, as regard to the substantial problems in administrative ethics construction in contemporary China, these issues still need to be solved, such as what kind of ethical value oriention should we establish? How to standardize administrative subject's official acts in moral ways? And how to explore the path of administrative ethics development required by the times, etc. The paper starts with the administrative ethics theory logically, making positive investigations on the status of the civil servant's administrative ethics in H County and S town, to find out the dilemmas of our cuntry's grass-root civil servants' administrative ethics, explore substantial countermeasures to improve the dilemmas of civil servants'administrative ethics and come up with a new perspective and solution to China's grass-root civil servants'reform.Administrative ethics is the union that includes the subjects such as administrative institutions, administrative organizations and administrative officials, and it also includes series of principles which fulfill the requirements of the value of ethics in making administrative decisions, operating administrative government and reforming administrative system and aim at pursuing the public's common interest, achieving social fairness and justice, and maintaining the public ethics order. Analyzing theoretically, administrative ethics dilemma generally refers to the dilemma on ethical level when civil servants engage in public affairs and exercise their individual rights, and it closely relates to their position and personal power, their responsibilities, the serving groups that they face and the multiple roles they play. It bacially derives from the individual mandate. Authoritative scholar Terry-L-Cooper has more in-depth study in the dilemma of administrative ethics. He analyzes the dilemma from three angles, namely: confliction of power, confliction of interest and confliction of roles. Based on the authoritative recognition and scientific rationality of this view, this paper mainly illustrates the dilemmas of the civil servants'administrative ethics.The author mainly adopts the simple random sampling (the SRS sampling) in the investigation, by giving out investigation questionnaires to part of civil servants in H county and S town, and combining with deep interview with part of grass-root masses. The article investigates mainly on the level of the recognition of grass-root civil servants'administrative ethics and their undertaking of responsibility, to find out the objects'cognition status of power view, interest view, fair view, and value view, and the status of their responsibilities'undertaking in practical life. This article has shown each statistical result in detail and carries on the analysis or induction from the scientific theory angle. Combining theoretical analysis with positive investigation, the author elaborates gross-root civil servants'administrative ethic dilemmas in three aspects:conflicts of civil servants'private right and social public power, confliction of loyalty to the organization and the public accountability, and the adversity of grass-root civil servants'roles. Embarking on the realistic dilemmas, the author concludes the causes of the problems, from the aspects of the exploration based on the theory of power confliction, grass-root civil servants' recognition dislocation when confronting multiple interest guidance and improper role location. The key of this article is to make practical and feasible countermeasures depending on the problems and causes, to help grass-root civil servants to go out of administrative ethical dilemmas. First of all, the measures should start with the administrative subjects or civil servants, that is to promote their individual's ethic autonomy and to cultivate and form responsibility consciousness step by step, according to three stages of individual moral development, the heteronomy-autonomy-union of heteronomy and autonomy. Secondly, the outside systems should reinforce the restraint of grass-root civil servants'authority, mainly by establishing specific responsibility ethic organizations of civil servants and perfecting administrative ethics training and inspection mechanism to regulate their individual acts. At last, depending on publishing and supervising mechanism, we should carry out civil servants' responsibility system to the full, making the civil servants'administrative ethics open and legal.
