The right to education is a basic rights for survival and development of Children with disabilities, it is the premise that the disabled children improve the quality of life, and obtain employment skills. and integrate into society well. Since the "Twelfth five-year" plan, special education develop faster in China. The proportion of the Children with disabilities to receive compulsory education is rising, but it is great different among the disabled children. The purpose of this paper is to discuss who are the most urgent need of special education in China and giving government some advise on the special education laws and regulations.This paper is divided into four parts. The first part, telling an autistic child has many troubles in studying because no schools want to receive him. So I have strong feelings about the special education objects.The second part, this paper analyzes the definition of special education about disabled children in our country, and the overview of special education. The paper also analyzes the problem of the current academic research on special legislation so as to provide some reference for carrying out the following parts.The third part, to explore the theoretical and practical significance of this study, and the research thought and the methods to use.The fourth part, this paper from four aspects, for example, the enrollment rate, different education status, national disabled children, styles of receiving education and related special education laws and regulations analyzes the status and problems of special education for the disabled.The fifth part, at present, most of the autistic children do not enjoy public education resources, lack of teachers, lack of legislative guarantee, and so on in our country. So the paper advises that some measures should be put forward to solve the problem of the compulsory education on autism children as soon as possible. Especially, giving a detail demonstration about the education right of autistic children on the special education legislation.The sixth part, at present, it is difficult to meet special education needs of most cerebral palsy, multiple and severely disabled children, these disabled children in a high proportion of out-of-school children. So the paper advise to give a detail demonstration about the education right of these children on the special education legislation.The seventh part, In order to meet the needs of different types of Children with disabilities special education, guarantee the right to education of disabled children, the paper advise should keep education fair, popularity of inclusive education, the improvement of teaching quality, the investment of funds and the parents should keep duty of performance.
