For a long time the international academic rank of the universities in our country are not high, and the efficiency is low. From the point of view of the new institutional economics, the fundamental reason is the institutional.lag. This thesis is composed for the purpose of arousing attention to the institutional problems in Chinese universities, and promoting the researches on establishing the Chinese modern university institution.Conversion from the traditional university institution to the modern university institution is the start and stand of this thesis. Some basic concepts are expounded clearly and the state-of-the-art of this research is analyzed in Chapter 1. Thereafter, in Chapter 2, the characteristic of current Chinese and Occidental university institutions are stated and their operation efficiency are compared. The fundamental reason of the difference of operation efficiency between the Chinese and the Occidental universities proposed in this article is not the lack of institution supply during the changing period in China, but the unchanged property right relationship and the governance structure itself. Therefore, it is necessary to analyze the property right theory and the principal-agent theory in Chapter 3, and it is concluded that during the changing period, serious limitations exist in the Chinese university property right system and the governance structure. Since the traditional university institution endures the unavoidable shortcomings, the changes of the institutions and establishment of modern university institution has become the inevitable choice of the Chinese universities. Hence, in Chapter 4, the changes model of the Chinese university institutions is proposed on the basis of the analysis of the institutional change principles, including the reasons and essences of the changes of the institutions changing modes, inherent mechanism and path dependence, etc.The new institutional economics theory runs through the whole thesis. In the detailed statement, theories on institution demand and supply, property right and principal-agent theory and the institutional change theory in the new institutional economics are adopted in turn. Studying methodologies including the contrastive analysis method,coherent analysis method of history and logic, systematic analysis method, statistical analysis method and the abstract method from universal to individual,are applied in this thesis. Some valuable conclusions are drawn by using these methods, combining the above theories and associating with the Chinese and the Occidental university institution practices.The new argumentations of the thesis are as following: the radical cause of the large difference between the Chinese and the Occidental universities' operation efficiency is not the lack of institution supply of Chinese education during the changing period, but the university institution itself, namely the university property-right institution and governance structure are not adaptable to the requirement of market economy; the property-right and principal-agent theory of university institutions are analyzed systematically and their shortcomings in Chinese universities in the changing period are stated out; this thesis infers that, to establish the modern university institution, the government dominant imposed institutional change should be transited to the university demanding induced institutional change, and they must be combined together very well in the actual operations; it is also thought that the path dependence problem of modern university institutional change should be attached importance to, and the idea of boosting the step-by-step change and innovation is proposed. The above argumentations provide the exploration of new theory and references, to boost the innovation of higher education and to establish the modern university institution in our country, which demonstrate theoretical and practical meanings in some degree.
